How long does it take to register a trademark?
Normally, it takes 5–6 months. The duration of trademark examination by the Patent Office is defined by the current legislation of the Federation and international treaties.
Is it possible to speed up the registration process?
There is an option of speeding up the examination process by the Patent Office that is subject to payment of extra govt fees. Such fees are usually equal to about $2000 — $2600 (150–200 thousand rubles). Bear in mind, though, that an application filed under this procedure carries the risk of being disputed on the basis of international applications filed later.
When can I start using my trademark?
Ideally — from the moment it’s officially registered with the Patent Office so that you can avoid accusations from the third parties in stealing from them. That being said, the law does not prohibit the use of a designation (name, logo) while it’s still being examined by the patent office. However, we should warn you that by using a designation not yet registered as a trademark, you bear the risk of violating someone’s rights without knowing it.
Where is my trademark protected after registration?
To obtain protection in other countries, an additional filing of an international application or individual applications to the patent offices of other countries is required.
Is it possible to get trademark protection in each country in the world?
It is possible, but the general procedure of the «world» trademark registration as such does not exist. You can register a trademark in other countries by filing separate applications with the patent offices of those countries, or a special Madrid application — with patent offices of several countries at once.
